Conservatives Slam Chief SCOTUS Justice John Roberts Amidst Claims He Has “Abandoned His Oath” following Rulings They Didn’t Like

Conservative lawmakers have slammed Supreme Court Chief Justice John Roberts since he sided with the court’s liberal judges in a 5-4 decision that shot down a Nevada church’s request to keep the state government from putting a limit on the number of people who can attend services.

The decision was handed down prior to the death of Justice Ruth Bader Ginsburg.

Sen. Ted Cruz (R-Texas) posted on Twitter that Roberts had “abandoned his oath.”

Senator Tom Cotton (R-Ark.) asked, “What happened to that judge?”

Cotton said in a statement:

“Freedom of religion is our first freedom. Yet SCOTUS has ruled that casinos can host hundreds of gamblers, while churches cannot welcome their full congregations.

Justice Roberts once again got it wrong, shamefully closing church doors to their flocks.” 

The decision was made in regard to a suit brought forth by Calvary Chapel Dayton Valley.

The church claimed that other businesses in the state were allowed to open up to half of their capacities while places of worship in Nevada were limited to 50 people at a time amid the pandemic.

The church maintained that this was a violation of the First Amendment.

The state of Nevada defended that it did not unfairly target churches or places of worship, saying that places where other large gatherings occurred – like concerts or theaters – were treated “the same as or worse than houses of worship.” 

After being rejected by district and circuit courts, it finally made its way to the Supreme Court. :

Justice Samuel Alito wrote in dissent,

“The Constitution guarantees the free exercise of religion. It says nothing about the freedom to play craps or blackjack, to feed tokens into a slot machine, or to engage in any other game of chance. But the Governor of Nevada apparently has different priorities.

That Nevada would discriminate in favor of the powerful gaming industry and its employees may not come as a surprise, but this Court’s willingness to allow such discrimination is disappointing. We have a duty to defend the Constitution, and even a public health emergency does not absolve us of that responsibility.”

Counsel for the state of Nevada pointed out last week that several courts nationwide are following the Supreme Court’s lead in this type of emergency restrictions during COVID-19.

The lawyers wrote, “Temporarily narrowing restrictions on the size of mass gatherings, including for religious services, protects the health and well-being of Nevada citizens during a global pandemic.”

This is not the first time the Supreme Court has ruled against a church challenging the limit on number of people who can gather for services.

Back in May of 2020, it ruled 5-4 in a very similar case from California.
