Texas AG Paxton Facing Possible Disbarment Over “Frivolous” Election Lawsuit

The top law enforcement officer in Texas, Ken Paxton, sure doesn’t seem to have much regard for rules. Under indictment since 2015 for alleged securities fraud, Paxton now is being investigated by the State Bar of Texas over the lawsuit that he filed in an attempt to overturn the results of the 2020 presidential election.

Even after it became clear that Joe Biden had won the election, Paxton, a Republican, filed a lawsuit in early December asking the court to extend a deadline for certification of presidential electors in Georgia, Michigan, Pennsylvania and Wisconsin. He alleged that election irregularities had occurred in those four states. The lawsuit was ridiculed by many legal experts and ultimately was rejected by the U.S. Supreme Court without even being heard.

A retired reporter for the Houston Chronicle, Kevin Moran, filed a grievance with the State Bar of Texas. Moran, who is president of the Galveston Island Democrats, said in his filing that Paxton knew the election lawsuit lacked legal merit and was a “frivolous” waste of taxpayers’ money.

“Knowing that the national election had NOT been rigged or stolen, he acted in a way to stoke those baseless conspiracy theories nationwide,” Moran wrote. He also noted that any other non-elected lawyer in Texas would face disciplinary action for filing a frivolous lawsuit. Paxton faces a reprimand or possibly even disbarment. Moran said, “With his track record, I believe he should be disbarred.”

Paxton is being challenged for the attorney general’s office in next year’s Republican primary by George P. Bush, who currently is the state’s land commissioner. The state’s highest law enforcement position has been a launching point for a number of Texas politicians, including Gov. Greg Abbott and U.S. Sen. John Cornyn.
